Terms of Service

These Terms of Service govern your use of Yindi AI's platform and services. By signing up or using our services, you agree to be bound by these terms. Please read them carefully. This agreement is between Yindi AI Pty Ltd (“Yindi”, “we”, “us”) and you (“Customer”, “you”).
1. The Services
Yindi provides AI-powered phone answering services, including but not limited to: inbound call handling, absence reporting, message taking, call routing, SMS notifications, and CRM integration. The specific features available to you depend on your subscription plan.
We may update, modify, or discontinue features of our services from time to time. Where changes are significant, we will provide reasonable notice.
2. Account Registration
To use Yindi, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us immediately if you suspect unauthorised access
You must be at least 18 years old and have the authority to enter into this agreement on behalf of your business or organisation.
3. Subscriptions & Payment
Yindi operates on a monthly subscription basis. Pricing is as displayed on our website at the time of signup and may be updated with notice.
- Subscriptions are billed monthly in advance
- Included call minutes and SMS are as per your plan; overuse is billed at the applicable overflow rate
- A one-time setup fee applies for new accounts
- All prices are in Australian Dollars (AUD) and exclude GST unless stated otherwise
- Payment is due on your monthly billing date
We offer a 30-day money back guarantee for new customers. After this period, subscriptions are non-refundable for the current billing period.
4. Cancellation
You may cancel your subscription at any time through your account dashboard or by contacting us. Cancellation takes effect at the end of your current billing period — you retain access until then.
We reserve the right to suspend or terminate your account if you breach these terms, fail to pay, or use the service in a way that causes harm to others.
5. Your Responsibilities
By using Yindi, you agree that you are responsible for:
- Caller disclosure — informing callers that they may be interacting with an AI system, as required by applicable Australian telecommunications and consumer laws
- Recording consent — ensuring you have appropriate authority or consent to record calls in your jurisdiction
- Lawful use — using Yindi only for lawful business purposes
- Accurate knowledge base — ensuring the information you train Yindi on is accurate and up to date
- Data protection — complying with the Australian Privacy Act and other applicable laws in relation to information collected through Yindi on your behalf
6. Acceptable Use
You must not use Yindi to:
- Engage in illegal, fraudulent, or deceptive activity
- Harass, deceive, or mislead callers
- Collect information from callers without appropriate disclosure
- Interfere with or disrupt our platform or other customers
- Attempt to reverse engineer or copy our technology
We reserve the right to suspend accounts that violate these terms without notice.
7. AI & Service Accuracy
Yindi uses artificial intelligence to handle calls. While we work hard to ensure accuracy, AI systems can make mistakes. You acknowledge that:
- Yindi may occasionally misunderstand callers or provide incorrect information
- We are not liable for errors made by the AI in handling calls
- You should have processes in place to handle escalations and corrections
- Critical decisions should not rely solely on AI-captured information without human review
8. Intellectual Property
The Yindi platform, technology, branding, and software are owned by Yindi AI Pty Ltd. We grant you a limited, non-exclusive licence to use the platform for your business during your subscription period.
You retain ownership of the content and data you provide to train Yindi (e.g. your knowledge base, FAQs, staff lists). You grant us a licence to use this information solely to provide the service.
9. Limitation of Liability
To the maximum extent permitted by Australian law, Yindi's liability for any claim arising from these terms or use of our services is limited to the amount you paid us in the 3 months preceding the claim.
We are not liable for indirect, consequential, or incidental damages, including lost profits, missed business opportunities, or data loss.
Nothing in these terms excludes rights you may have under the Australian Consumer Law that cannot be excluded.
10. Privacy
Your use of Yindi is also governed by our Privacy Policy, which is incorporated into these terms by reference.
11. Changes to These Terms
We may update these terms from time to time. We will notify you of significant changes via email at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
